Justice S S Sundar quashed the order recently while allowing a writ petition from K Krishnan, P B Sampath Kumar and Shanthi Rao.
The judge observed that from the admitted facts, it is seen the department has passed the impugned order in a hurry without issuing notice to the petitioners under the pretext that they, who had failed to avail an opportunity or appear before the Enquiry Officer, are not entitled to them. Factually, it is pointed out that the petitioners have participated in the enquiry by submitting objections which are common to every one of them.

கோவிலின் அறங்காவலர்கள் அனைவரையும் அறங்காவலர் அலுவலகத்தில் இருந்து நீக்கிய மாநில சுற்றுலா, கலாச்சாரம் மற்றும் சமய அறநிலையத் துறையின் இந்த ஆண்டு ஆகஸ்ட் 8 தேதியிட்ட உத்தரவை ரத்து செய்ய வேண்டும் என்று மனுவில் கோரப்பட்டது.
ஒப்புக்கொண்ட உண்மைகளின்படி, மனுதாரர்களுக்கு ஒரு வாய்ப்பைப் பயன்படுத்தத் தவறிய அல்லது விசாரணை அதிகாரி முன் ஆஜராகவில்லை என்ற சாக்குப்போக்கின் கீழ் நோட்டீஸ் வழங்காமல் அவசர அவசரமாக தடை உத்தரவு பிறப்பித்துள்ளது என்பதை நீதிபதி கவனித்தார். அவர்களுக்கு உரிமை. உண்மையில், மனுதாரர்கள் ஒவ்வொருவருக்கும் பொதுவான ஆட்சேபனைகளை சமர்ப்பித்து விசாரணையில் பங்கேற்றுள்ளனர் என்று சுட்டிக்காட்டப்படுகிறது.
எவ்வாறாயினும், தடை செய்யப்பட்ட உத்தரவு இயற்கை நீதியின் கொள்கைகளை மீறுவதாகக் கூறி தள்ளுபடி செய்யப்பட்டுள்ளதால், விசாரணையை மீண்டும் தொடங்குவதற்கு துறைக்கு திறந்திருக்கும் என்று நீதிபதி கூறினார். PTI CORR SA SA
The judge, however, said since the impugned order is set aside only on the ground that it is in violation of principles of natural justice, it is open to the department to reopen the enquiry afresh. PTI CORR SA SA
